What is a contingency fee arrangement?

Personal injury attorneys often use a contingency fee arrangement, which allows clients to retain the services of an attorney with no upfront cost. Without this kind of payment arrangement, many people would be unable to afford to hire an attorney after an auto accident. A contingency fee means that the attorney will not receive payment for the work if monetary damages are not obtained on your behalf. If the attorney does win a settlement, you pay the attorney an agreed upon percentage of that amount.

The client-lawyer relationship section of the Mississippi Rules of Professional Conduct states that the contingency fee arrangement must be in writing, including the method by which the fee will be determined, the percentage that accrues to the lawyer after settlement and whether litigation expenses are included or calculated separately. The lawyer must provide the client with a written statement showing how much the client will receive and how that amount was determined.

How are litigation expenses handled?

It is important to discuss whether your lawyer will be advancing litigation costs for your case. If not, you will have to pay them upfront. If so, you will reimburse your attorney out of the settlement amount.
