How Much Does a Personal Injury Lawyer Cost in Mississippi?
Full disclosure about what it costs to retain an attorney
You have been involved in a serious car accident, You are dealing with medical bills, the damage to your vehicle and missed work and are wondering how you are going to pay for everything. If another party was at fault in your accident, you may be able to file a claim for monetary damages for your financial losses and pain and suffering. You may be able to claim punitive damages as well. Your friends keep telling you to hire a personal injury attorney, but you have never hired an attorney before. Aren’t they expensive? With all the money going out right now, how will you pay a lawyer to help you get it back? At the law firm of Cumbest, Cumbest, Hunter & McCormick, we know you have these questions and many others if you were involved in an accident. We are here to answer them for you and to help you understand how you can afford to hire an experienced personal injury attorney to represent your interests and seek the fair compensation you deserve for your injuries.
What is a contingency fee arrangement?
Personal injury attorneys often use a contingency fee arrangement, which allows clients to retain the services of an attorney with no upfront cost. Without this kind of payment arrangement, many people would be unable to afford to hire an attorney after an auto accident. A contingency fee means that the attorney will not receive payment for the work if monetary damages are not obtained on your behalf. If the attorney does win a settlement, you pay the attorney an agreed upon percentage of that amount.
Law firms use different percentages when calculating their contingency fees. This percentage varies depending on where you live and the size and reputation of your lawyer’s firm. The fees can range from 20 percent up to 50 percent; however, the average is 33 percent to 40 percent.
With this arrangement, you do not have to pay the attorney anything if the case is lost and you do not collect any damages, but the amount the lawyer receives increases with the amount of the settlement, so this creates a natural incentive for your attorney to fight for a larger award.
The client-lawyer relationship section of the Mississippi Rules of Professional Conduct states that the contingency fee arrangement must be in writing, including the method by which the fee will be determined, the percentage that accrues to the lawyer after settlement and whether litigation expenses are included or calculated separately. The lawyer must provide the client with a written statement showing how much the client will receive and how that amount was determined.
How are litigation expenses handled?
Trying cases costs your attorney money. Your lawyer will incur fees for court filing, travel and document processing and will also have to pay for the services of investigators and expert witnesses.
It is important to discuss whether your lawyer will be advancing litigation costs for your case. If not, you will have to pay them upfront. If so, you will reimburse your attorney out of the settlement amount.
